Terms and Conditions

1.            Application

1.1          When these terms and conditions apply. These terms and conditions (together with any other terms and conditions set out on our website) will apply to all orders placed and accepted through our website. Please read them carefully before you submit an order.

1.2          Our right to change these terms and conditions. We reserve the right to change these terms and conditions from time-to-time by updating them on our website.

2.            About us and how to contact us

2.1          Who we are. We are Monster Dog Designs, an unincorporated business established in England and Wales.

2.2          How to contact us. You can contact us by email using the details listed on our website.

2.3          How we may contact you. If we have to contact you we will do so using the email address, postal address or telephone number provided to us in your order.

2.4          "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

3.            Our contract with you

3.1          How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

3.2          If we cannot accept your order. We will do our best to fulfil your order, but on occasion it may be necessary for us to refuse your order if, for example, the product in question is out of stock. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product.

4.            Our products

4.1          Products may vary slightly in appearance. The images of the products on our website are for illustrative purposes only. As our products are handmade and due to the nature of the fabric we use, there may be slight variations in product colours.

4.2          Making sure your measurements are accurate. Please ensure that you measure your dog correctly in accordance with the instructions provided on our website. If we are providing you with a custom order, we are making the product to measurements you have given us and you are responsible for ensuring that these measurements are correct.

5.            Providing the products

5.1          Delivery costs. The costs of delivery will be as displayed to you on our website.

5.2          When we will provide the products. Products will be posted to you with Royal Mail by 1st or 2nd class post at your request when ordering. We will endeavour to post the product as soon as possible and within no more than one week from the date your order is accepted (or within no more than two weeks for a custom order). If we are unable to post the product within this period we will notify you in writing of the estimated time of dispatch and allow you the opportunity to cancel your order if our estimate is not acceptable to you. We cannot guarantee delivery dates.

5.3          When you own the product. You own the product(s) you have ordered once we have received payment in full and the item has been dispatched.

6.            Cancellations and returns

6.1          Your right to cancel your order. If you change your mind about your order, you may cancel it within 14 days of your order being accepted. The product(s) ordered must be unused and in a saleable condition and will be inspected when returned to us.

6.2          How to cancel your order. If have changed your mind about your order and wish to cancel, please contact us by email using the contact information on our website.

6.3          Custom orders. We are unable to offer refunds for custom orders once the product has been made.

6.4          Other returns. If there is fault with the product you have ordered or you believe that the product you have received is not as described, please contact us by email using the contact information on our website providing details.

6.5          Cost of returns. You are responsible for the cost of return postage unless the product is faulty or is not as described.

6.6          How we will refund you.  We will refund you the price you paid for the products by the method you used for payment within 5 working days of us receiving the returned products.

6.7          Deductions from refunds. If you have changed your mind about your order, we may reduce your refund of the price if we reasonably believe that the product has been used. Any reduction made shall be calculated to reflect what we reasonably believe to be the reduction in value to the product caused by its use.

7.            Price and payment

7.1          Where to find the price for the product. The price of the product is the price indicated on our website. The price does not include postage costs which are stated separately. Prices may be changed from time-to-time.

7.2          When and how you must pay. Payment must be made by credit or debit card using the payment facility on our website or through Paypal. Payment must be made immediately at the point of ordering.

8.            Liability

8.1          Customer’s responsibilities. You are wholly responsible for ensuring that the products sold on our website are suitable for your dog and that they are sized, fitted and used correctly.

8.2          Limitation of liability. We shall not be liable for any loss or damage suffered through the use of our products, save where such loss or damage is the direct result of a fault which was not reasonably apparent upon a reasonable inspection of the product, in which case we shall not be liable for any indirect or unforeseeable loss or damage.

9.            How we may use your personal information

9.1          How we may use your personal information.  We will only use your personal information as set out in our Privacy Policy which is available on our website.

10.          Other important terms

10.1       Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

10.2       If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.3       Which laws apply to this contract. These terms and conditions are governed by English law. The English courts shall have exclusive jurisdiction to hear and determine any claim or dispute relating to these terms and conditions and our products.
